The law is clear under New York Vehicle and Traffic Law section 1143. A vehicle entering the roadway “shall yield the right of way to all vehicles approaching on the roadway to be entered or crossed.” This section applies to all motor vehicles entering the roadway from:

- Grass/off-street parking
- Garage
- Public turnoff
- Roadway shoulder, or
- Other similar roadway structures or pull offs.
